Terms & Conditions

The below Terms & Conditions are subject of all PT Neptune Liveaboards Indonesia reservations and are to be referred to whenever needed by either website visitors, new leads, existing reservations or other interested third-parties.

1. INCLUSIONS / EXCLUSIONS
1.1 INCLUSIONS1.2 EXCLUSIONS:
– Accommodation in a double-bed or twin-bed cabin, either lower deck or upper deck as chosen by the guest;
– Unlimited satellite internet usage;
– Unlimited 4G / 5G Hotspot internet usage;
– Full on-board service which is including three daily meals (breakfast, lunch and dinner) as well as daily snacks, all day coffee and tea
– Daily guided dives + night dives depending on the itinerary;
– 80 cf tank (12 liters), and weights belts are included;
– Airport and hotel transfers in the specific destination.
– International and Domestic flights;
Transit hotel reservations;
Harbor and Park Fees which can be subject to changes depending on local regulations out of the control of Neptune Liveaboards;
Scuba Diving and Snorkeling gear (see onboard prices section);
Scuba Diving Courses (see onboard prices section);
100 cf tank (15 liters);
Laundry Service;
Use of a satellite phone;
Crew gratuities;
Mandatory Dive Insurances;
Beer, wine, soft drinks and other alcoholic beverages.

Special provision

All scuba diving activities are subject to weather conditions, transit times and, unexpected circumstances out of the control of Neptune Liveaboards and unexpected mechanical failures which cannot be fixed en-route.

Scuba diving is not performed on departure dates.

The itineraries, scheduled dive sites, are all subject to change depending on weather, guest dive experience and any other unforeseen circumstances.

2. RESERVATIONS AND DEPOSITS

2.1 DEPOSIT FOR INDIVIDUAL BOOKINGS:

All direct bookings of Neptune Liveaboards reservations are confirmed on-line via E-mail or WhatsApp, directly through one of our Reservations Attendants. Additionally, reservations can also be confirmed through third-party private agents and online travel agents such as PADI Travel or Liveaboard.com

To confirm a single (FIT) booking, a deposit of 20% of the total price per person is to be paid to confirm the reservation. All reservations / bookings are based on first come first served basis using deposit payments as confirmations. Until the deposit payment is issued and received, the booking is not considered confirmed and the cabin/spot/space can be reserved by another single (FIT) booking.

Balance for single (FIT) bookings is payable 90 days prior to the scheduled trip date.

2.2 DEPOSITS FOR GROUPS AND FULL CHARTER BOOKINGS:

  • A deposit of 10% (non-refundable) from the total booking value is necessary to be paid to confirm the group reservation / charter.
  • A second deposit of 20% mid-term deposit is payable at the half time between the invoice date and travel date (non-refundable, non-transferable).
  • The final balance is payable 90 days prior to the travel date (non-refundable, non-transferable).
3. SHORT NOTICE BOOKINGS

In case of short notice bookings which represent single bookings (FIT), group bookings and charters, a full payment is required to be able to confirm the reservation if the departure date is within 90 days prior to the departure date.

Reservations, bookings and payments for short notice bookings are non-refundable and non-transferable due to the time sensitivity of the logistics necessary.

4. PAYMENT GUIDELINES

4.1 BANK TRANSFERS

All types of bookings are able to use bank transfers for deposit and balance payments for either single bookings, group bookings as well as charters. Upon receiving the invoice, specific bank account details are provided.

4.2 CREDIT CARD PAYMENT

For all our services we accept credit / debit card payments through a third-party payment processor. Transaction fees of 3% apply which are non-negotiable and non-refundable.

Credit / debit card transactions are processed by our third party partners. Neptune Liveaboards does not store nor save any credit / debit card information except minimum personal information used for identifying the payment such as but not limited to: First Name, Last Name, E-mail Address, Country, Card last 4 digits.

4.3 ONBOARD PAYMENT GUIDELINES

Any purchases made onboard must be honoured with preferably in cash although credit/debit card payments are available as well with 1% transaction fees.

5. CANCELLATION POLICY

5.1 GENERAL:

All cancellations must be submitted in writing to our reservations e-mail [email protected] or via WhatsApp.

5.2 AMENDMENT GUIDELINES:

For any changes requests 90 days or less prior to the travel date, an administrative charge will be applied of 1% from the total booking amount. Any changes requested to the booking date are treated as cancellations and new bookings of a cruise which in return can mean extra charges if the new booking price is higher than the previously booked trip. All amendment / change requests must be submitted in writing via e-mail to [email protected]

The date that the amendment / change request is received by Neptune Liveaboards, is the date that will count towards the administrative charge.

5.3 CANCELLATION FEES:

Any cancellations received in the last 121 days prior to the departure date is subjected to minimum 10% deductions.

The date when Neptune Liveaboards receives the cancellation via e-mail is the date used to determine the 10% deduction. To be noted, legal working dates exclusively are counted for the 10% deduction. Correspondence received on weekends or national holidays are not taken in consideration.

5.3.1 CANCELLATION FEE POLICY FOR INDIVIDUAL BOOKINGS:

The following cancellation fees are charged for cancellations within 120 days or less prior to departure:

  • 5.3.1.1 – 120 to 91 days prior to departure, 25% of the cruise rate cancellation fee applies.
  • 5.3.1.2 – 90 days or less prior to departure 100% of the cruise rate.

5.3.2 CANCELLATION FEE POLICY FOR GROUPS OR FULL CHARTERS:

  • 5.3.2.1 – More than 270 days, a fee of 1500 USD is applied
  • 5.3.2.2 – 270 to 181 days prior to departure, a fee of 5000 USD is applied
  • 5.3.2.3 – 180 days to 91 days prior to departure a fee of 40% of the cruise rate is applied

5.3.3 REDUCTION OF NUMBER OF PASSENGERS ON A FULL CHARTER

  • 5.3.3.1 – More than 9 months (271 days) prior to the travel date: the reservation may be reduced down to one paying passenger which will result in loss of complimentary space(s).
  • 5.3.3.2 – From 270 days to 181 days prior to the travel date: 20% of the individual rate per passenger cancelled is forfeited. Additionally, a reduction / loss of complimentary space(s) is applied.
  • 5.3.3.3 – From 180 to 91 days prior to the travel date, 40% of the charter rate per passenger cancelled is forfeited. Additionally a reduction / loss of complimentary space(s) is applied.
  • 5.3.3.4 – 90 days or less prior to the travel date, all refunds are forfeited.

In any case of a reduction of the number of passengers on charter bookings, the following applies

a. The surcharge for Upper Deck VIP Cabins applies unless otherwise written stated by Neptune Liveaboards.

b. Specific itineraries or activities may be canceled or altered to accommdoate new customers booked by Neptune Liveaboards or other third party agents.

5.3.4 REDUCTION OF NUMBER OF PASSENGERS ON A GROUP CHARTER

In case of reduction of number of passengers on a group booking, the same terms and conditions apply as per individual bookings (FIT) as well as the same cancellation fees.

5.4 TRAVEL CANCELLATION INSURANCE:

Neptune Liveaboards highly recommends all customers to purchase travel cancellation insurance, as well as any other insurance that is considered necessary but not limited to: health insurance, scuba diving insurance, etc.

Travel insurance helps protect against any potential unforeseen cancellations either from the guest side or from Neptune Liveaboards. In case of such cancellations, Neptune Liveaboards will provide all necessary assistance for documentation required by the insurance company.

5.5 SUBSTITUTE PASSENGERS:

If for any reason or circumstance a passenger cannot honour a trip that has already been booked, the booked passenger can transfer the reservation to another passenger, friend, family or otherwise. The new passenger will be subject to Neptune Liveaboards Terms and Conditions, the same as the initial passenger / customer was initially subject.

Neptune Liveaboards does not accept any liability for any travel arrangements or costs that may arise in circumstances of substitute passengers.

5.6 PASSENGER MISSING IN ACTION POLICY:

Under any circumstances or if for any reasons a passenger does not manage to honour the meeting point (airport, harbor, boat, etc…) and time, Neptune Liveaboards will continue to apply it’s outmost capabilities to ensure a reasonable waiting time for the missing passenger. The reasonable time is calculated based on existing passengers already embarked on which additional unplanned waiting time may be applied due to the missing passenger.

In the extreme case that the missing passenger is not able to join the specific booked trip until the planned departure time of the specific trip, Neptune Liveaboards will consider the missing passenger as a last minute cancellation and will reject any liability either direct or indirect.

6. CHANGES TO BROCHURE DESCRIPTION AND/OR WEBSITE, CHANGES TO RATES AND TRANSPORTATION COSTS

6.1 CHANGES BEFORE CONFIRMED BOOKINGS:

Prior to confirmed bookings, during the negotiations / communications stage, Neptune Liveaboard reserves the right to alter, modify or cancel various details, aspects or any other information of its services, price lists, etc. Such alternations, modifications or cancellations are to be communication to the parties involved.

6.2 PRICE CHANGES AFTER BOOKING CONFIRMATIONS:

In rare but possible circumstances, prices or costs may be increased. These circumstances are as follows:

1. Increases in transportation costs (including fuel costs);

2. Increases in state taxes and duties (i.e. embarkation/disembarkation fees, sales taxes, etc.);

3. Extreme currency fluctuations;

4. Any National Park Fee increases;

6.3 ITINERARY AND SERVICE CHANGES AFTER BOOKING AND BEFORE DEPARTURE:

Neptune Liveaboards reserves the right to change itineraries as well as particular services if and when required as a result of unforeseen circumstances. Neptune Liveaboards will apply all efforts to offer equal alternatives of comparable standards.

Any such unforeseen circumstances will be communicated by Neptune Liveaboards in a timely manner as received by Neptune Liveaboards.

7. CANCELLATIONS BY NEPTUNE LIVEABOARDS

7.1 FORCE MAJEURE AND UNPREDICTABLE ACTS OF MAN:

Neptune Liveaboards will reserve all rights to cancel or amend / change any trip for reasons of Force Majeure (i.e. natural disasters, epidemics, etc.) or unforeseen, unavoidable, unpredictable acts of man (i.e. war, riots, strikes, etc.).

7.2 TRIP CANCELLATION BY NEPTUNE LIVEABOARDS:

In the event of unforeseen, unpredictable or unavoidable circumstances such as but not limited to: mechanical and engineering issues, safety issues, covid outbreak, or any other such events that are not within direct power of Neptune Liveaboards, to the extend that Neptune Liveaboards has applied all necessary measures to avoid the trip cancellation, Neptune Liveaboards may cancel a specific trip, booking, reservation, group booking or charter.

The cancellation can happen a significant time prior to the travel date as well as a significantly short time before the travel date including last minute cancellations.

8. CHANGES TO THE ITINERARY AND SERVICES

In outstanding events or for any reason not within the powers of Neptune Liveaboards, specific itineraries may be cancelled, altered or changed for safety reasons to either the vessel, crew or passengers. Such changes, alterations or cancellations may occur on last minute circumstances.

9. DAMAGES RESULTING FROM PERSONAL INJURY, ILLNESS, OR DEATH

Damages resulting from illness, personal injuries, or death which may be sustained by reason of, or while engaged on, any trip whether due to the ownership, maintenance, use, operation, or control of any aircraft, helicopter, automobile, bicycle, boat, vehicle, hotel, common carrier or any other conveyance used in carrying out these trips, Neptune Liveaboards assumes no liabilities due to any cause whatsoever whether caused by failure or delay or other irregularity, acts, or omissions occurring during a trip under which the means of transportation or other service provided thereby is offered or supplied by owners, operators, or public carriers for and on behalf of Neptune Liveaboards. Neptune Liveaboards shall not be responsible for any injury to a person (whether or not resulting in death) or damage to property arising out of any act of war, insurrection, revolt, or other civil uprising or military action occurring in the countries of origin, destination or passage. In case of a medical problem arising during the voyage, either onboard or onshore, which results in costs for evacuation, use of aircraft, or repatriation, the responsibility for payment of these costs belongs solely to the passenger.

Neptune Liveaboards may employe particular third party services from freelancers or any other third party entity for the sole purpose of serving the passengers for activities such as but not limited to: hotel and airport transfers, water taxies, tender transfers, ferry transports, etc. In any extreme case of any damages, either resulting in personal injury, illness, death or damages of personal goods, Neptune Liveaboards does not accept any liabilities for the actions of the employed freelancers or other third party entities.

10. LOSS OR DAMAGE TO PERSONAL BELONGINGS

During passenger transits to the departure / arrival destination, during any cruise or any trip either operated by Neptune Liveaboards or not, during any hotel or airport transit or transfer operated by any freelancer or any other third party, Neptune Liveaboards does not accept liability for any loss or damage to personal belongings.
